the minutes of the canvass of votes o!
October 9, 2003 for the Iowa City
Primary Election.
Motion by Stutsman, second by
Lehman, to approve the payroll author-
izations submitted by department
heads, as approved by a majority of
the Supervisors.
Convened Public Hearing on Road
Vacation 01-2003 at 9:03 a.m.
Road Vacation 01-2003 That por-
tion of 540th Street SW, which lies
between Lackender Avenue SW and
Kansas Avenue SW. Said segment of
road is approximately 4,605 feet in
length.
Rick and Irvin Grout spoke against
the road vacation because it would
landlock their property. County
Attorney J. Patrick White said the
Board wouldn't normally act on the
vacation today. White said that if in fact
the vacation cuts access off to the
Grout's property the Board could still
vacate the road but he would recom-
mend that they don't. Neuzil said this
needs to be researched before he
would feel comfortable doing anything.
Lehman said they've asked Secondary
Roads to look at vacating some of the
level B roads to save costs but the
Board needs to make sure that every-
one has access to their property. The
Board discussed vacating a portion of
the road. Stutsman said that histori-
cally if there is an objection to a road
vacation the Board doesn't go through
with it.

Reconvened Public Hearing of
April 17, 2003 for Conditional Use
Permit Application CU03002 at 9:30
a.m.
Application CU03002 of Willis Mast
requesting a Conditional Use Permit to
operate canned goods reclamation
operation as a Home Business on
property described as Lot 1 of Dirty
Face Addition, located in the SW 1/4 of
the SW 1/4 of Section 17, Township 78
North, Range 7 West of the 5th P.M. in
Johnson County, Iowa. (This parcel is
located on the east side o| HazeLwood
Avenue SW, approximately 700' north
of its intersection with 520th Street SW
in Sharon Twp.)
Willis Mast spoke for the applica-
tion. Assistant Planning and Zoning
Administrator R. J. Moore said the con-
ditional use permit cannot be approved
until a permanent occupancy permit
has been granted. Moore said the
building inspectors have told him that
once corrections are made to the prop-
erty, which are minor, the occupancy
permit will be issued.
RESOLUTION 10-16-03-Z1
RESOLUTION APPROVING THE
CONDITIONAL USE PERMIT FOR A
HOME BUSINESS - A PRICING CEN-
TER
Whereas, the owner has filed
application CU03002 for approval of a
Conditional Use Permit for a Home
Business for a pricing center, and
Whereas, the Johnson County
Board of Supervisors have reviewed
said application and finds the pro-
posed use to be consistent with the
requirements of Chapter 8:1.34.H.4 of
the Johnson County Zoning
Ordinance.
Now, Therefore, Be it Resolved by
the Board of Supervisors of Johnson
County, Iowa:
1. That said Conditional Use Permit be
approved subject to issuance of an
occupancy permit within 30 days.
2. That the Chairperson be directed to
sign said permit once all other condi-
tions have been met.

FROM A1-RURAL DISTRICT & RS-
SUBURBAN RESIDENTIAL DIS-
TRICT TO RS20-SUBURBAN RESI-
DENTIAL DISTRICT
SECTION I. PURPOSE. The purpose
of this ordinance is to amend the
Johnson County Zoning Ordinance by
changing the classification of the real
estate described in Section II hereof
from A1-Rural District & RS-Suburban
Residential District to RS20-Suburban
Residential District.
SECTION II. CHANGE IN CLASSIFI-
CATION. The zoning classification of
the following described real estate
located in Oxford Township and com-
prised of approximately 21.67-acres to
wit:
Part of Section 8, Township 80 North,
Range 8 West of the 5th P.M. in
Johnson County, Iowa. See Plat of
Survey recorded in the Johnson
County Recorder's Office in Book 46,
Page 159, w/o right-of-way.
is hereby changed from A1-Rural
District & RS-Suburban Residential
District to RS20-Suburban Residential
District.
SECTION III. DISTRICT MAPS. The
portion of the District Maps maintained
in accordance with Chapter 8:1.5.2 of
the Johnson County Zoning Ordinance
as pertains to the real estate described
in Section II of this ordinance is hereby
repealed and amended to reflect the
foregoing change in classification.
SECTION IV. REPEALER. All other
ordinances or parts of ordinances in
conflict with the provisions of this ordi-
nance are hereby repealed.
SECTION V. SAVINGS CLAUSE. If
any section, provision or part of this
ordinance shall be adjudged invalid,
illegal or unconstitutional, such adjudi-
cation shall not affect the validity of the
ordinance as a whole or any section,
provision or part thereof not adjudged
invalid, illegal or unconstitutional.
SECTION VI. EFFECTIVE DATE. This
ordinance shall become effective, after
its passage and approval, upon publi-
cation as part of the proceedings of the
Board of Supervisors.

Stutsman, second by Thompson, to
waive the requirement of three consid-
erations before amending an ordi-
nance and to approve Application
Z03009 on first and second considera-

Whereas, the Johnson County
Planning and Zoning Commission, fol-
lowing a public hearing, on October 13,
2003, filed its report and recommenda-
tions for certain actions;
Now, Therefore, Be It Resolved as
follows:
1. A public hearing in accordance with
Section 335.6 of the Iowa Code is set
for the 13th day of November, 2003 at
6:00 p.m. in the Board Room, Johnson
County Administration Building, 913
South Dubuque Street, Iowa City,
,Iowa, on the following: Z03010
(Terrell), Z03011 (Busch, Ryan-Busch,

contract for EAP (Employee
Assistance Program) services effective
November 16, 2003 to November 15,
2004.

Lehman, to declare broken computer
equipment submitted by Information
Services as surplus property and no
longer of County use and authorize for
disposal by stripping of it of all useful
parts and then taking it to the landfill.
