Johnson County Administration Building at
5:30 p.m. Members present: Mike Carberry,

ment heads, as approved by a majority of the Supervisors.
Motion by Harney, second by Green-Douglass, to approve the application to renew the Special
Class C Liquor License, Application for Sunday Sales Privilege, for KC Family Center, Iowa
City, as submitted by Randy Troa.
Planning, Development, and Sustainability (PDS) Temporary Assistant Planner Mitch Brouse
presented the following zoning and subdivision applications.
Convened Public Hearing on Zoning Application 26281 at 5:32 p.m.
Rezoning Application 26281 of Bruce D. Wright, requesting rezoning of 0.08 acres from A-
Agricultural to R-Residential, of a certain property described as being located in the NW 1/4 of
the NE 1/4 of Section 22, Township 81 North, Range 8 West of the 5th P.M. in Johnson County,
Iowa. The property is located on the east side of Derby Ave NW approximately 3,300 feet south
of its intersection with Plotz Road NW, in Monroe Township.
Scott Ritter with Hart Fredrick Consultants spoke about the application.
Public Hearing closed at 5:36 p.m.
Motion by Harney, second by Rettig, to waive the requirement of three considerations before
approving an ordinance amending the Johnson County Unified Development Ordinance, Zoning
Application 26281. Roll call: aye: Carberry, Green-Douglass, Hamey, Rettig, Sullivan.
Motion by Rettig, second by Carberry, to approve Zoning Application 26281 on first and second
consideration. Roll call: aye: Carberry, Green-Douglass, Harney, Rettig, Sullivan.
Convened Public Hearing on Zoning Application 26282 at 5:37 p.m.
Rezoning Application 26282 of BA&K Inc., Signed by Aaron Klosterman, requesting rezon-
ing of 25.12 acres from A-Agricultural to AR-Agricultural Residential, of a certain property
described as being located in the NE 1/4 of the NW 1/4 of Section 18, Township 81 North,
Range 6 West of the 5th EM. in Johnson County, Iowa. The property is located on the west side
of Sandy Beach Road NE approximately 650 feet south of its intersection with 140th Street NE,
in Big Grove Township.
Harney said he agrees that sensitive areas needs to be addressed but he has concerns about the
road cpunt and said the closest gravel road does not flood. Brouse said 140th Street does flood,
but Naples Avenue does not flood. There would likely be egress.
Sullivan asked if staff discussed conditional zoning. Brouse summarized a conversation on this
subject he had with Assistant PDS Administrator Josh Busard and the applicant.
Rettig said this is a difficult application because the area was platted so long ago. She suggested
the applicant consider rezoning the area to AR-10, or find another way to get rid of the potential
for six houses. Also, she is not interested in pursuing this application without storm water man-
agement and sensitive areas regulations.
Harney said he has the same concerns. He would agree to a Conditional Zoning Agreement that
limits the number of houses to two. Brouse spoke about additional steps the applicant will have
to take if he applies for AR-10 zoning.
Officials discussed the awkward panhandle area that is included in the North Corridor Develop-
ment Area.
Assistant County Attorney Andy Chappoll said the Board could possibly accomplish everything
they want with a Conditional Zoning Agreement, or the applicant could withdraw this applica-
tion and file a different application for another zoning. Officials continued to discuss the number
of lots and Road Performance Standards. Carberry said there may be equity issues pertaining to
how other lot owners would be affected by conditional zoning.
Sullivan asked Chappell how the Board would proceed if the applicant wants to compromise.
Chappell replied the only requirement is that a Conditional Zoning Agreement must be signed
before the Public Hearing doses.
Glen Meisner of MMS Consultants, Inc., applicant Aaron Klosterman, and Attorney Ryan Prahm
spoke for the application.
A straw poll of Board members indicated they are interested in pursuing a Conditional Zoning
Agreement to address storm water management and sensitive areas. Chappell advised the Board
how to address accessory buildings. Klosterman requested the Board defer the application.
Motion by Rettig, second by Harney, to continue the Public Hearing and defer consideration of
Zoning Application 26282 to March 24, 2016, at 9:00 a.m.
Convened Public Hearing on Zoning Application 26295 at 6:29 p.m.
Rezoning Application 26295 of Allan D Meier, requesting rezoning of 5.08 acres from R-Res-
idential to AR-Agricultural Residential, of a certain property described as Lot 1 of Brarmaman's
North Addition and is located in the NE 1/4 of the NE 1/4 of Section 11, Township 81 North,
Range 5 West oftbe 5th EM. in Johnson County, Iowa. The property is located on the cul-de-sac
of North End Court NE approximately 600 feet northeast of its intersection with White Oak Ave
NE, in Cedar Township.
Hamey'asked for clarification on how Agricultural Residential zoning is different from Residen-
tial zoning. Brouse said the same home business rules apply but AR allows different conditional
uses, including recreational uses, and has different animal rules. Harney asked about access to
the lot and Brouse replied.
Sullivan noted his concern with a loophole; there is an extremely steep slope to the noah and
the area is heavily wooded, and the only way to gain access is to build a road through this very
sensitive area, yet the Sensitive Areas Ordinance does not apply here.
Rettig said she does not want to support the application without certain conditions and said PDS
Soil and Water Conservation Specialist Kate Giarmini should help determine these conditions.
Sullivan,nAked Chappell to comment on how to proceed if the Board wants a Conditional Zoning
Agreement with this application. Chappell said if there are concerns related to the nature of the
land, the Board may place conditions on the zoning.
Green-Douglass said she thinks the Board would be irresponsible if they pursue this zoning,
without conditions, with the topography and current access points; too much land is likely to
get disrupted.
Bob Hoosier spoke for the application.
Chappell advised the Board on language that will best address the specific concerns with sensi-
tive areas and stormwater management should the Board agree to a Conditional Zoning Agree-
ment.
Motion by Rettig, second by Hamey, to continue the Public Hearing and defer consideration of
Zoning Application 26295 to March 17, 2016, at 9:00 a.m.
Convened Public Hearing on Subdivision Application 26088 at 6:50 p.m,
Subdivision Application 26088 ofKeith Rayner, requesting preliminary and final plat approval
of Pleasant Valley Acres Subdivision, a farmstead split described as being located in the W 1/2 of
the SE 1/4 of Section 36, Township 78 North, Range 6 West of the 5th EM. in Johnson County,
Iowa. This property is located on the north side of 580th Street SE approximately 2,000 feet west
of its intersection with Sioux Avenue SE, in Pleasant Valley Township.
Brouse said all oftbe documents are complete and staffrecommends approval of the application.
Green-Douglass asked about the permitted lot size of farmstead splits and Brouse said they can
be between one and five acres.
Hamey asked iftbe farmer will have an issue with access to either side of the farm since the
driveway is so long. Brouse said the farmer has many access points around the property.
No one from the public spoke. Public Hearing closed at 6:52 p.m.
RESOLUTION 03-08-16-01
RESOLUTION APPROVING THE FINAL PLAT AND SUBDIVIDER'S AGREEMENT
OF PLEASANT VALLEY ACRES SUBDIVISION JOHNSON COUNTY, IOWA
Whereas, the owner has filed application 26088 for approval of the final plat of Pleasant Valley
Acres Subdivision and
Whereas, the County Zoning Commission having studied said application recommends that the
plat be approved.
Now, Therefore, Be It Resolved By the Board of Supervisors of Johnson County, Iowa:
1. That said plat be approved.
2. That the Chairperson be directed to sign said plat and Subdivider's Agreement.
3. This Resolution requires the recording of the following documents: A. Resolution & Docu-
ments: Owner's Certificate, Opinion of Attorney, Certificate of County Auditor, Fence Covenant'
Certificate of the Treasurer, Subdivider's Agreement, Durable Power of Attorney for Financial
Management, Resolution Affirming the Stability of the Current Road System; B. Subdivision
Plat (5).

Business Associate Agreement with Amerigroup Iowa, Inc., effective April 1, 2016, for case
management services.

sign the Long Term Services and Supports Memorandum of Understanding with Amerigroup of
Iowa, Inc., effective April 1, 2016, for case management services.
Motion by Green-Douglass, second by Carberry, to approve and authorize the Chairperson to
sign the Ancillary Services Agreement with AmeriHealth Caritas Iowa, Inc., effective April 1,
2016, for case management services.
Motion by Green-Douglass, second by Rettig, to approve and authorize the Chairperson to sign
the Addendum to the Business Associate Agreement with AmeriHealth Caritas Iowa, Inc., effec-

RESOLUTION 03-08-16-02
RESOLUTION AWARDING AND AUTHORIZING EXECUTION OF CONTRACT
FOR CONSTRUCTION OF THE JOHNSON COUNTY AMBULANCE SERVICE AND
MEDICAL EXAMINER FACILITY PROJECT
Whereas, on the 4th day of February, 2016, afler notice as required by law, a public hearing was
conducted concerning the proposed plans, specifications and form of contract for, and the esti-
mated cost of, construction of the Johnson County Ambulance Service and Medical Examiner
Facility Project; and
Whereas, afier said public hearing and hearing all the evidence presented, and on that date the
Johnson County Board of Supervisors gave due consideration to and adopted a resolution ap-
proving said proposed plans, specifications, form of contract for, and the estimated cost of, said
construction, and providing that sealed bids for the construction of said Building be solicited
for receipt by the Johnson County Auditor no later than 2:00 P.M. Central Time, March 1, 2016,
Notice to bidders being published pursuant to the Iowa Code; and
Whereas, at saidtime and place the bids were opened and the amounts of all bids announced
and it was determined that the lowest responsive, responsible bidder, determined pursuant to
Iowa Code §§ 26.9-.10, was Portzan Construction of Dubuque, Iowa, and said bid was for
$7,489,000.00.
Now, Therefore, Be It Resolved that Portzen Construction of Dubuque, Iowa, was the lowest re-
sponsive, responsible bidder for the proposed project' and that the bid amount is $7,489,000.00,
for construction of the Johnson County Ambulance Service and Medical Examiner Facility Proj.
ect' as shown in the plans previously adopted by the Board;
Be It Further Resolved that the Board hereby awards the contract for construction of Johnson
County Ambulance Service and Medical Examiner Facility Project, as shown in the plans previ-
ously adopted by the Board to Portzen Construction of Dubuque, Iowa, and authorizes the Chair-
person (or in the Chairperson's absence the Vice-Chalrporson) to sign any documants, including
the previously approved form of contract, necessary to effectuate said award of contract in such
manner as is consistent with Iowa law.

RESOLUTION 03-08-16-03
RESOLUTION APPROVING USE OF A PROJECT LABOR AGREEMENT FOR THE
JOHNSON COUNTY AMBULANCE SERVICE AND MEDICAL EXAMINER FACIL-
ITY PROJECT
Whereas, the Johnson County Board of Supervisors has determined that a project labor agree-
ment should be drafted and entered into with the Cedar Rapids and Iowa City Building Trades
Council for the Johnson County Ambulance Service and Medical Examiner Facility Project
(hereinafter "the Project"); and
Whereas, an applicable project labor agreement has been draRed by County staff and their terms
considered by the Board of Supervisors; and
Whereas, the Board of Supervisors believes that a project labor agreement will positively af-
fect the construction of the Project by prohibiting work stoppages, providing access to a broad
workforce, and ensuring that skilled labor is utilized, and that the quality of the work performed
will be enhanced due to the existence of a project labor agreement; and
Whereas, the Project will be funded exclusively with local funds; and
Whereas, the Board of Supervisors further believes that for all of these reasons antering into a
project labor agreement is in the best interests of the residents of Johnson County.
Now, Therefore, Be It Resolved that the Board of Supervisors approves the use of a project
labor agreements in the construction contracts for the Ambulance Service and Medical Examiner
Facility; and
Be It Further Resolved that the Johnson County Board of Supervisors hereby approves the for-
mat of the attached project labor agreement, to be signed by the Board, the general contractor,
and the individual trades listed therein, and further authorizes the Chair to sign the project labor
• agreement on behalf of the Board of Supervisors and Johnson County, Iowa.
Motion by Green-Douglass, second by Carberry, to approve Resolution 03-08-16-03.
Chappell spoke about how the County, the City of North Liberty, and the City of Coralville will
address the County Engineer's concerns with maintenance on North Liberty Road and Dubuque
Street.
Motion by Rettig, second by Carberry, to approve and authorize the Chairperson to sign a
28E Project Agreement between the City of North Liberty, the City of Coralville, and Johnson
County related to North Liberty Road and Dubuque Street Improvements.
Chappell spoke about purchasing property to the north of the Ambulance Services Building.
Motion by Rettig, second by Carberry, to approve and authorize the Chairperson to sign an
Agreement for Temporary Use of Public Right-of-Way with the City of Iowa City, for a portion
of Dubuque Street and Lafayette Street.
Motion by Harney, second by Green-Douglass, to accept the low bid of $155,186.25 from
Boulder Contracting, LLC for Project L-S-29-2--73-52, a bridge replacement project on Taft
Avenue SE over an unnamed tributary to Buck Creek, and authorize the Chairperson to sign a
contract and bond.
Motion by Rettig, second by Green-Douglass, to approve and authorize the Chairperson to sign
a letter indicating that Johnson County will participate in the Data-Driven Justice Initiative.
RESOLUTION 03-08-16-04
FYI7 BIWEEKLY SALARIES FOR ELECTED OFFICIALS
Whereas, the Johnson County Compensation Board meets annually to recommend a compensa-
tion schedule for elected officials for the fiscal year immediately following, in accordance with
Iowa Code Chapters 331.905 and 331.907, and
Whereas, the Johnson County Compensation Board met on January 13, 2016, and made the fol-
lowing salary recommendations for the following elected officials for the fiscal year beginning
July 1, 2016:

RESOLUTION 03-08-16-05
ADOPTING THE FISCAL YEAR 2016-2017 COUNTY BUDGET AND CERTIFICATE
OF TAXES
Whereas, the Board of Supervisors conducted a public hearing on February 29, 2016 whereupon
the proposed fiscal year 2016-2017 county budget was presented to the citizens of Johnson
County; and
Whereas, the citizens of Johnson County were invited to comment on the proposed fiscal year
2016-2017 county budget, as duly published in the official publications of Johnson County; and
Whereas, the Board of Supervisors appreciates the attendance at the public hearing and the com-
ments from citizens who spoke at the public hearing, and encourages all citizens to be informed
and participate in county government; and
Whereas, the Board of Supervisors has carefully taken into consideration the opinions expressed
at the public hearing.
Therefore, be it resolved that the fiscal year 2016-2017 county budget and certificate of taxes
is adopted as per the Proposed Johnson County Budget Summary for fiscal year 2016-2017.

RESOLUTION 03-08-16-06
RESOLUTION EXPRESSING INTENT TO AUTHORIZE A LOAN AGREEMENT
AND ISSUE BONDS IN AN AMOUNT NOT TO EXCEED $13,450,000
Whereas, Sections 331.402 and 331.441 of the Code oflowa authorize counties to enter into loan
agreements and borrow money for the purpose of acquiring equipment and making improve-
ments to county buildings; acquiring computer equipment and sofcware for use in county build-
ings; paying the cost of various county insurance programs; paying the cost of capital projects
for the construction, reconstruction, improvement, repair or equipping of bridges, roads and
culverts if such capital projects assist in economic development which creates jobs and wealth
or if such projects relate to damage caused by a disaster or are designed to prevent or mitigate
disasters; and funding programs to assist in providing affordable housing (the "Essential County
Purposes"); and
Whereas, Sections 331.402 and 331.442 also authorize counties to enter into loan agreements
and borrow money for the purpose of acquiring vehicles and equipment for the county sheriff,
ambulance and conservation departments; and
Whereas, the Board of Supervisors (the "Board") of Johnson CounW, Iowa (the "County"), has
proposed to enter into a loan agreement (the "Essential County Purposes Loan Agreement") in a
principal amount not to exceed $13,100,650, pursuant to the provisions of Sections 331.402 and
331.441 of the Code of lowa, for the purposes of paying the cost, to that extent, of the Essential
County Purposes, and has published notice of the proposed action and has held a hearing thereon
on February 29, 2016; and
Whereas, the Board has also proposed to enter into a loan agreement (the "County SberiffLoan
Agreement") in a principal amount not to exceed $]71,750, pursuant to the provisions of Sec-
tions 331.402 and 331.442 of the Code of Iowa, for the purposes of paying the cost, to that
extent, of acquiring equipment and vehicles for the County Sheriff, and has published notice of
the proposed action and has held a hearing thereon on
February 29, 2016, and no petition has been filed asking that the question of entering into the
County Sheriff Loan Agreement be submitted to the registered voters of the County; and
Whereas, the Board has also proposed to enter into a loan agreement (the "Ambulance Depart-
ment Loan Agreement") in a principal amount not to exceed $149,600, pursuant to the provisions
of Sections 331.402 and 331.442 of the Code of Iowa, for the purposes of paying the cost, to that
extent' of acquiring vehicles and equipment for the Ambulance Department, and has published
notice of the proposed action and has held a hearing thereon on February 29, 2016, and no peti-
tion has been filed asking that the question of entering into the Ambulance Department Loan
Agreement be submitted to the registered voters of the County; and
Whereas, the Board has also proposed to enter into a loan agreement (the "Conservation Depart-
ment Loan Agreement") in a principal amount not to exceed $28,000, pursuant to the provisions
of Sections 331.402 and 331.442 of the Code of Iowa, for the purposes ofpaylng the cost, to that
extent, of acquiring a vehicle for the Conservation Department, and has published notice of the
proposed action and has held a hearing thereon on February 29, 2016, and no petition has been
filed asking that the question of entering into the Conservation Department Loan Agreement be
submitted to the registered voters of the County; and
Whereas, the Essential County Purposes Loan Agreement, the County SheriffLoan Agreement,
the Ambulance Department Loan Agreement and the Conservation Department Loan Agreement
are hereinafler referred to as the "2016 Loan Agreement"; and
Whereas, it is necessary at this time for the Board to express its intent to authorize the 2016 Loan
Agreement for the purposes set out above and to express its intent to issue General Obligation
County Purpose Bonds in a principal amount not to exceed $13,450,000 (the "Bonds") to be
issued inthe future in evidence of the obligation of the County under the 2016 Loan Agreement;
Now, Therefore, Be It Resolved by the Board of Supervisors of Johnson County, Iowa, as fol-
lows:
Section 1, The Board hereby expresses its intention to enter into the 2016 Loan Agreement and
to issue the Bonds in the furore, in a principal amount not to exceed $13,450,000, and the Board
hereby declares that this resolution constitutes the additional action required by Section 33 i.402
of the Code of Iowa.
Section 2. All resolutions or parts thereof in conflict herewith are hereby repealed to the extent
of such conflict.
